Bytes The Dust LLC — Terms of Service

These Terms of Service (“Terms”) govern your use of services operated by Bytes The Dust LLC, sometimes shortened to BTD, including the Warp Relay ranking system, account system, Mod Mail services, websites, bots, APIs, and related services (collectively, the “Services”).

By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree to these Terms, you should not use the Services.

1. About Bytes The Dust LLC

Bytes The Dust LLC (“BTD,” “we,” “us,” or “our”) operates and maintains the Services described above.

2. Eligibility

You must be legally permitted to use the Services in your jurisdiction.

If you use the Services on behalf of another person or organization, you represent that you have authority to accept these Terms on their behalf.

3. Accounts

Certain Services may require you to create or link an account.

You are responsible for:

• Providing accurate information where required.

• Maintaining the security of your account.

• Keeping your authentication credentials secure.

• All activity performed through your account, except where caused by unauthorized access that was not reasonably preventable.

We reserve the right to suspend or terminate accounts that violate these Terms or are used to abuse, exploit, or interfere with the Services.

4. Warp Relay Ranking System

Warp Relay may provide rankings, ratings, statistics, leaderboards, match histories, player profiles, and other competitive information.

Rankings may be calculated using automated systems and may change as a result of:

• Reported match results.

• Rating calculations.

• Corrections to match results.

• Administrative actions.

• Detection of fraudulent or invalid results.

• Changes to ranking algorithms.

BTD does not guarantee that rankings will always be accurate, uninterrupted, or free from errors.

BTD may correct, modify, remove, or invalidate rankings, matches, statistics, or other competitive records when reasonably necessary.

5. Mod Mail

The Services may provide a Mod Mail system that allows users to communicate with moderators or administrators.

Messages submitted through Mod Mail may be accessed by authorized BTD staff, moderators, administrators, or service operators for purposes including:

• Responding to support requests.

• Moderation.

• Investigating reports.

• Preventing abuse.

• Maintaining the security of the Services.

• Enforcing these Terms.

• Resolving disputes.

You should not submit passwords, payment information, government identification numbers, or other highly sensitive information through Mod Mail unless specifically requested and appropriate.

6. Acceptable Use

You agree not to use the Services to:

• Break applicable laws or regulations.

• Harass, threaten, or abuse other users.

• Impersonate BTD staff or another person.

• Submit fraudulent or intentionally misleading match results.

• Manipulate rankings or statistics.

• Exploit bugs or vulnerabilities for malicious purposes.

• Attempt to gain unauthorized access to accounts or systems.

• Interfere with the operation of the Services.

• Upload malicious software or harmful content.

• Circumvent account suspensions or other moderation actions.

• Use the Services in a manner that could damage BTD, its infrastructure, or other users.

BTD may take appropriate action when these rules are violated.

7. User Content

You may submit content through the Services, including Mod Mail messages, usernames, reports, match information, and other communications (“User Content”).

You retain ownership of User Content to the extent you have applicable rights in that content.

By submitting User Content, you grant BTD a non-exclusive, worldwide, royalty-free license to store, reproduce, process, and display that content as reasonably necessary to operate, maintain, moderate, and improve the Services.

BTD does not claim ownership of your User Content merely because you submit it to the Services.

8. Third-Party Services

The Services may interact with third-party platforms or services, including services used for authentication, communication, hosting, or game-community functionality.

Your use of those third-party services may also be governed by their own terms and privacy policies.

BTD is not responsible for the availability, security, or policies of third-party services outside BTD's control.

9. Availability

BTD strives to keep the Services available but does not guarantee uninterrupted operation.

Services may be temporarily unavailable because of:

• Maintenance.

• Software updates.

• Infrastructure failures.

• Security incidents.

• Third-party outages.

• Network problems.

• Circumstances outside BTD's reasonable control.

10. Account Termination

You may stop using the Services at any time.

BTD may suspend or terminate access to an account when reasonably necessary to:

• Enforce these Terms.

• Protect users or the Services.

• Investigate abuse or fraud.

• Comply with legal obligations.

• Respond to security incidents.

Where appropriate, BTD may provide notice before taking action, but this may not be possible in every circumstance.

11. Disclaimer

The Services are provided on an “as is” and “as available” basis to the maximum extent permitted by applicable law.

BTD does not guarantee that:

• The Services will always be available.

• Rankings or statistics will always be accurate.

• The Services will be error-free.

• Data will never be lost.

• The Services will meet every user's particular requirements.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Bytes The Dust LLC and its members, employees, contractors, administrators, and service operators will not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use the Services.

Nothing in these Terms is intended to exclude liability that cannot legally be excluded or limited under applicable law.

13. Changes to These Terms

BTD may update these Terms from time to time.

When material changes are made, BTD may provide notice through the Services, Email, or other reasonable means.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by law.
